Lower Brule Man to be Sentenced for Grand Theft and DUI Charges

PIERRE, S.D. – (DRG News) A Lower Brule man will be sentenced next month for his no contest plea to Grand Theft-Possession of Stolen Property and his guilty pleas to DUI-3rd and Failure to Report an Accident. 27-year-old Brian Byington was arrested in March after an accident that occurred at the intersection of Wells and Harrison Avenues in Pierre. Byington was driving a vehicle on March 12 when he struck another vehicle and didn’t stop to report the accident. Police said Byington left the scene and he was later stopped by officers a few blocks away. Byington admitted his guilt to the DUI and Failure to Report an accident charges last month. Yesterday, he entered a no contest plea to Grand Theft-Possession of Stolen Property after authorities discovered that the vehicle he was driving when the March accident occurred had been stolen. Byington will be sentenced in June, when he faces up to 10 years and a $20,000 fine for the Grand Theft charge and two years and a $4,000 fine for DUI-3rd.
