Pierre Man Changes Plea to Assault Charge

PIERRE, S.D. – (DRG News) A Pierre man pled guilty to Aggravated Assault-for an incident that occurred in January when a woman was hit in the head with a shovel. 40-year-old Orville Whiteeyes, Jr. changed his plea in court yesterday and admitted his guilt to the assault charge. He had pled not guilty in February. A count of Simple Assault Domestic Violence was dismissed. Judge John Brown told Whiteeyes that the assault charge is a Class 3 Felony that carries a maximum sentence of 15 years, a $30,000 fine or both, plus restitution. Hughes County States Attorney Kelly Marnette says that Whiteeyes had been drinking on January 28 when he used a shovel to strike a woman in the forehead, just outside the American Legion Cabin. He will be sentenced on June 5.
