PIERRE, S.D. – (DRG News) A Lower Brule man pled guilty to two charges that resulted from a March accident in Pierre. 27-year-old Brian Byington was indicted on charges of DUI-3rd and Failure to Report an Accident after a crash that occurred in Pierre on March 12. In court yesterday, he pled guilty to both charges. Hughes County States Attorney Kelly Marnette said that Byington had been operating a car when he struck another vehicle and didn’t stop and report the accident. He was caught by law enforcement a few blocks away. She says sobriety tests showed he had a blood alcohol content of .332. Byington’s attorney asked that her client be released from jail while he awaits a May sentencing date. Judge John Brown ordered that Byington remain in custody and that a chemical dependency evaluation be completed while he is jailed. Byington will be sentenced on May 15, when he could be given up to two years for the DUI count and one year for failing to report the accident.
